§ 11.3. Power to Create Districts

A)

The Council, subject to applicable restrictions in the Colorado Constitution, shall have full authority to create by ordinance special assessments or taxing districts within and without the Town, to construct, install, acquire, operate, maintain or fund any public improvement or any public service.

B)

Prior to the creation of any district with separate assessment or taxing powers or which is intended to assess or tax the costs of improvements against the property within the district, a hearing shall be held following notice to the owners of record to be subject to the proposed assessments or taxes.
