§ 5.10. Prohibited Action by Council

  • An ordinance adopted by the electorate may not be amended or repealed without voter approval for a period of two (2) years after the date of the election at which it was originally adopted, and an ordinance repealed by the electorate may not be re-enacted for a period of two (2) years after the date of the election at which it was repealed without voter approval. Any ordinance may, with voter approval, be adopted, amended, or repealed at any time by referendum or initiative procedure, or if submitted to the electorate by the Council on its own motion. If two or more ordinances adopted at the same election shall have conflicting provisions, the provisions in the ordinance receiving the highest number of affirmative votes shall govern.
