§ 5.5. Procedure on Petitions

  • Upon presentation to the Council of an initiative or referendum petition by the Town Clerk, the Council shall, within thirty (30) days, either:

    A)

    Adopt the ordinance as submitted by an initiative petition, unless the ordinance requires voter approval in advance pursuant to the Colorado Constitution; or

    B)

    Repeal the ordinance, or part thereof, referred by a referendum petition; or

    C)

    Determine to submit the proposal provided for in the petition to the electors. An initiated ordinance requiring voter approval in advance pursuant to the Colorado Constitution shall require only a single election under either subsection (A) or this subsection (C).
